Welcome to Zion Fly Fishing Tours LLC. Before we hit the water, all participants must review and sign this liability waiver and promotional media release. This is a legally binding document. Please review thoroughly before signing. By signing, you confirm that you have read and understand this document in full. By signing you explicitly agree to assume all risks associated with this excursion and agree to release Zion Fly Fishing Tours LLC from all liability.
1. Voluntary Participation & Description of Activities
I, the undersigned, acknowledge that I have voluntarily chosen to participate in guided fly fishing trips, wading, boating, and related outdoor activities (collectively, the "Activities") organized, conducted, or provided by Zion Fly Fishing Tours LLC.
2. Assumption of Inherent Risks
I understand and acknowledge that outdoor angling, wading in water, and watercraft navigation involve inherent, inescapable risks. These risks include, but are not limited to:
Changing weather conditions, extreme heat, cold, lightning, and natural disasters.
Hypothermia, drowning, entanglement, and collisions with objects or other watercraft.
Deep water, slippery rocks, currents, and underwater hazards.
Encounters with wildlife, insects, reptiles, and poisonous plants.
Equipment failure, hook punctures, cuts, slips, trips, and falls.
Remoteness from medical facilities, delaying emergency medical treatment.
Mistakes, poor judgment, or careless actions by fellow guests, guides, or other staff.
I explicitly agree to accept and assume all risks associated with my participation, both known and unknown.
3. Release of Liability & Indemnification
In consideration for being permitted to participate in the Activities, I hereby release, waive, and forever discharge Zion Fly Fishing Tours LLC, its members, managers, employees, independent contractors, affiliates and guides (the "Released Parties") from any and all liability, claims, demands, or causes of action arising out of negligence, personal injury, illness, death, or property damage sustained during the Activities. I agree to indemnify and hold harmless the Released Parties from any expenses, including attorney's fees, incurred due to claims brought by me or on my behalf.
4. Medical Certification & Authorization
I certify that I am in good physical condition and have no medical constraints that would endanger myself or others during these Activities. In the event of an emergency, I authorize Zion Fly Fishing Tours LLC staff to secure necessary medical treatment, and I accept full financial responsibility for all associated medical costs.
5. Compliance with Instructions and Rules
I agree to follow all guidelines, policies, and safety instructions provided by the company's guides and staff members. I understand that if I refuse or fail to follow these rules, Zion Fly Fishing Tours LLC reserves the right to terminate my participation immediately. In the event of such removal, I will not be eligible for a refund or trip credit.
6. Comprehensive Photo & Media Release
I hereby grant Zion Fly Fishing Tours LLC the absolute, irrevocable, and unrestricted right to capture, use, publish, distribute, and display photographic images, video footage, or audio recordings taken of me during the Activities. I understand these assets may be used for marketing, promotional materials, social media channels, websites, or commercial displays without compensation or further notice to me. I waive any right to inspect or approve the finished product.
7. Governing Law
This agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Utah. If any portion of this waiver is deemed invalid by a court of law, the remaining sections shall continue in full force and effect.
